This Vacation Rental Agreement (The Agreement) is made by and between GEEBEE COMPANIES LLC / Nathaly and Andres Guariguata (Homeowner) and (Guest) as of the date last set forth on the AirBnB Booking confirmation page for good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows.

Property: The Vacation Rental Property Located at :
3219 Virginia Street
Coconut Grove FL

Apt - 1 The Property is fully furnished and included :
Refrigerator, Range-e, Water Heater, A/C unit, Towels, Sheets, Full Equipped Kitchen (Cutlery, Toaster, Coffee maker, Microwave), bed, dining table, Smart TV, sofa bed, other furnitures and fixtures as they appear on the AirBnB photos.

This vacation rental agreement begins and ends as indicated by the booking reservation number generated by AirBnB after Guest agreed to continue with the reservation.

The rental party shall consist of Guest and any additional person stated at booking time or afterwards via modification:

The capacity of the house:
The total number of persons allowed in the houses at any one time is restricted to the number of persons scheduled and paid for in the reservation. The presence of additional guests will subject Guest to immediate eviction and forfeiture rent.

Rental Rules: Guest agrees to abide by the Rental Rules ( attached to this agreement ) at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while residing at the property.

Office Hours - The Office Hours are 8 am – 8 pm. Any issues related to the A/C, television, internet, plumbing or electricity will be addressed during normal Office Hours.
Cancellations and Refunds – Cancellation of or changes to your reservation must be made using the AirBnB platform and according to Owner selected cancellation policies at AirBnB.

TAXES: Guests acknowledges 6.0% Florida State Tax and 6.0% Dade County Tax will be collected by AirBnB, based on the gross rent for the term of the Agreement.

Inspection of Premises - Guests must contact the Owner within one (1) hour of arrival of the Premises to report any existing damage to the Premises. If the Guest does NOT contact the Owner within one (1) hour of arrival then the Premises are deemed accepted by the Guest in as-is where-is condition with no damage.

Damage Security Deposit – The Security Deposit, if any, is fully refundable by AirBnB; provided however, that there is no smoking in the Premises, breakage, damage, missing items, other charges incurred in connection with your use of the Premises. If the Security Deposit is not sufficient to cover any such smoking in the Premises, breakage, damage, missing items, other charges or additional cleanup, you hereby agree to immediately pay upon demand the Owners for any and all overages.

Furnishings and Linens - Furnishings of the Premises are subject to change without notice. Furniture, bedding, utensils or any other Premises supplied with the Premises must not be taken out or transferred from one Premises or another. The Premises is fully furnished, including a full kitchen, toaster, microwave oven, refrigerator, stove with oven, dishes, glasses, cutlery, and pots. Loss of these items, as well as damage to the Premises or furnishings in excess of normal wear, will be charged to the Guest. Moving of furnishings inside or outside the Premises is strictly forbidden. If any furnishings need to be moved back to original placement, there is a $125.00 charged to the Guest. A basic supply of linens is provided on each Premises. Bed linen and bath towels are not changed during your stay. Patio furniture (including cushions or coverings) is not to be taken to the beach. In the event, there are locked closets and/or pantries in this rental you may not, and you will ensure all of your family members, visitors and guests do not open any such locked closets and/or pantries. You as the Guest, agree to use your best efforts to ensure that all of your family members, visitors and other guests follow the rules and regulations outlined in this document. The Owner shall supply toilet paper, soap, dishwashing soap, garbage bags and coffee filters once at the beginning of the rental, and only enough for the first one or two days of visit. Guests should buy additional supplies as they see fit.
Laundry soap in the laundry room is NOT included in the reservation supplies.

TV and Cable - For your enjoyment, the unit is equipped with a Smart TV. You can sign in to the streaming service of your choice. WE DO NOT PROVIDE CABLE TV. Guests are responsible for signing out of any streaming service you signed in while visiting. Owner will not sign customers out of the services.

Security Cameras - The Building has security cameras in all exteriors and corridors.

The capacity of House – The total number of persons allowed in the houses at any one time is restricted to the number of persons scheduled and paid for in the reservation. The presence of additional guests will subject Guest to immediate eviction and forfeiture rent.
Parties and events are not permitted in the Premises.

Drugs and Hazardous Materials – The Guest, Guest’s family members, visitors, guests and other members of such Guest’s group are strictly prohibited from using or bringing onto the Premises any illegal substances, flammable fluids, explosives or other items deemed hazardous to life, limb or Premises, as determined by Owner, any party designated by Owner or Owner’s representatives.

Complaints and Maintenance - The Owner will make all reasonable efforts to keep the Premises and facilities located within the Premises in good working order. In the event there is a maintenance problem with any of the facilities located within the Premises; the Owner will take all reasonable steps to repair the problem as soon as possible after being notified in writing. No refund or rate adjustment will be made for unforeseen mechanical failures such as the supply of electricity, water, heater/filtration systems, air conditioning, television/cable service, internet (Wi-Fi), appliances, etc. Please note that internet (Wi-Fi) is a service offered by the building and the Owner is not responsible for any failure of this service. The Owner is only responsible for reporting problems with the internet (Wi-Fi). The Owner will not provide a refund for any failure of the services provided by the television/cable service or internet (Wi-Fi). It is the Guest’s responsibility to report any problems or damage immediately using the AirBnB platform.

Guest Rules and Regulations:

There is a strict occupancy limit of two individuals per bedroom. Any additional guest should be notified, and fees, if any, should be paid prior to arrival. No trash, garbage or debris shall be placed in any yard, porch or deck area. All garbage must be in plastic bags and deposited into the designated receptacles. No occupant shall make or permit any disruptive noises in or around the buildings or permit any conduct of any persons or service animals that will interfere with the rights, comforts or conveniences of other residents. No towels, clothing, linens, etc. shall be hung from the balcony rails, front porch or rear yards. Occupants found to be violating these rules may be evicted and fined.

No Smoking – Smoking is not permitted inside the unit. Evidence of smoking will cause immediate eviction, and forfeiture of Guest’s entire Rental Fee and Security Deposit.

Pets – Only service pets are allowed and shall not exceed a maximum weight of 20lbs.

Pet Deposit – The Pet Deposit shall be $500.00. In the event there is no damage to the Premises created by the pet then the Pet Deposit shall be returned. There shall be a cleaning fee in the amount of $250.00 charged.

No Assignment - Guest may not assign your rights under this Agreement, in whole or in part, without first obtaining the prior written consent of Owner.

Excessive Noise – Guest shall not use the Premises for any disorderly or unlawful purposes or in any manner offensive to others or in any manner which would constitute breach of the peace. Guest shall comply with all laws, rules and regulations. In the event the Guest displays excessive noise (music, television or loud voices) or parties then the Owner shall immediately evict the Guest and the Guest shall forfeit the balance of the Guest’s Rental Fee and Security Deposit.

Parking – The Premises has one (1) parking space per unit. The Guest may not park a second vehicle in another parking space. Street parking is allowed where permitted. We are not responsible for any belongings left in the car.

Guest Care of Premises - Guest shall take care of the Premises, its appliances, and furnishings and maintain the unit in a neat and sanitary condition. Guest will leave unit in the same condition as at check-in, including furniture placement.

Owners Responsibilities:
1. Owner agrees to provide the Premises in a clean condition.
2. Owner agrees to provide maintenance and repairs as required.
3. Owner agrees to allow for the full use and enjoyment of the Premises by Guest during the term of this Agreement provided the Guest abides by all terms of this Agreement.
4. Owner will NOT be responsible for loss, theft or injuries sustained by the Guest.

Right of Access – The Owner has the right to enter the Premises/units/apartments/rooms at any reasonable time without notice for the maintenance of the Premises with or without the Guest’s presence.

Emergencies – The Owner is not responsible for natural emergencies, illnesses or any personal accidents that may occur within the Premises.

Indemnification - Guest hereby agrees to indemnify and hold the Owner harmless for injuries or other losses to Guest and other persons that may occur in connection with Guest’s use of the Premises. Guest further agrees that Owner has no control over the condition of the Premises and, furthermore, that Owner is not under any obligation to accept for safekeeping any monies, securities, jewelry, or other articles. Guest acknowledges and agrees on Guest’s behalf an on the behalf of all of Guests family members, visitors, guest and other third parties occupying or using all or any part of the Premises that Owner is in no way responsible for any personal injury or bodily harm that may occur for any reason whatsoever on the Premises to any Guest, any family member of Guest, any visitor or guests or other third parties, nor for any damage or loss for any reason whatsoever of Guest’s, any family members of Guest, any visitor’s or guests’ or other third parties’ personal belongings. Guest hereby agrees to defend, indemnify and hold harmless Owner, and its employees and agents (collectively, the “Indemnified Parties”), from and against all claims, causes of action, lawsuits, damages, liabilities, and expenses (including reasonable attorneys’ fees) as may be incurred by Indemnified Parties because of Guest’s failure to comply and/or cause the compliance of Guest’s family members, visitors, guests and other third parties with the terms and conditions of this Agreement.

Comparable Premises and Force Majeure - Unforeseeable circumstances may arise, which make it impossible or impractical for Owner to provide the anticipated accommodations to our Guests. Such circumstances may include, but not be limited to, scheduling problems, equipment failure, road/building construction that may occur at, around, or near any of our properties or in Florida, as well as fire or another casualty at the Premises. In such a circumstance, Owner reserves the right to transfer Guest to another vacation Premises of reasonably comparable value, determined in the sole discretion of Owner, whose determination shall be final. In other circumstances which include, but not be limited to government actions, adverse weather or beach conditions, hurricanes, wind storms, fires or other natural occurrences, acts of God, acts of war, acts of terrorism, said circumstances not being exclusive, it may be impossible or impractical for Owner to make available reasonable or other alternative accommodations to Guest. In such a circumstance, if the Guest has not taken travel insurance, a refund of the unused rent in the amount determined at the sole discretion of Owner, whose determination shall be final, will be provided to the Guest.
